Terms of Use for the Biofolwark Portal

1. General Provisions
1.1. These terms and conditions define the rules for using the portal that enables the purchase of agricultural products from organic crops and viewing the offers of local producers' products.
1.2. The portal is operated by Cinematic Studio Adam Olejniczak, based in Łęczyca, ul. Zachodnia 7/29, 99-100 Łęczyca, registered under NIP: 507 002 12 05, REGON: 100543358.
1.3. Every user of the portal is obliged to comply with these terms and conditions.

2. Definitions
2.1. Portal – the website available at www.biofolwark.pl.
2.2. Administrator – Cinematic Studio Adam Olejniczak based in Łęczyca.
2.3. User – any person using the portal, including those purchasing agricultural products.
2.4. Products – agricultural articles from organic crops and products from local producers available on the portal.
2.5. Account – an individual user profile created by registering on the portal.
2.6. Seller – a user who has created a seller profile and received the administrator's approval to sell their products through the portal.
2.7. Seller Profile – a profile created by a user, which upon acceptance by the administrator, allows the sale of products through the portal.

3. User Registration and Account
3.1. Registration on the portal is voluntary and free of charge.
3.2. To register an account, the user must provide true personal information, including first name, last name, email address, and password.
3.3. The user is obliged to update their personal information in case of any changes.
3.4. The user’s account is secured by a password, which the user should protect from third-party access.
3.5. The administrator reserves the right to block or delete a user’s account in case of a breach of these terms and conditions.

4. Use of the Portal
4.1. The portal allows users to browse product offers, place orders, and make payments for purchased products.
4.2. The user is obliged to use the portal in accordance with applicable laws and social norms.
4.3. It is prohibited to use the portal in a manner that could disrupt its operation or infringe on the rights of other users.
4.4. The user may not use the portal for commercial purposes without the administrator's consent.
4.5. All content posted on the portal, including photos and product descriptions, is protected by copyright and may not be copied or used without the owner's permission.

5. Multivendoring
5.1. The portal allows users to create a seller profile that enables the sale of their own products through the portal.
5.2. To create a seller profile, the user must complete a registration form available on the portal and submit it to the administrator.
5.3. The administrator verifies the application within 72 hours of receipt. Upon positive verification, the seller profile is activated, and the user is notified via email about the possibility of starting sales.
5.4. In case of negative verification, the administrator informs the user of the reasons for the refusal and, if possible, indicates the steps to take to gain acceptance.
5.5. The seller is obliged to provide true and complete information about the offered products, including their descriptions, ingredients, prices, and availability.
5.6. The seller is fully responsible for the content of the offers posted and the compliance of the offered products with applicable laws.
5.7. The administrator reserves the right to delete or block the seller profile in case of a breach of the terms and conditions, including providing false information or offering products that do not comply with the law.
5.8. The seller is obliged to ensure the appropriate quality and safety of the offered products, in accordance with applicable standards and regulations.
5.9. The seller is obliged to comply with all applicable laws, including consumer protection, copyright, and personal data protection laws.
5.10. The seller is obliged to issue an invoice or receipt for each sold product in accordance with applicable tax regulations.
5.11. The seller is obliged to update the information on the availability and prices of products. In case of product unavailability, the seller should immediately inform the administrator and users.
5.12. The seller is responsible for timely delivery of products to users and for the compliance of the delivered product with the description posted on the portal.
5.13. Any disputes between the seller and the user will be resolved in accordance with applicable laws, and the administrator may mediate the resolution of the dispute.

6. Placing Orders
6.1. The user can place orders for products available on the portal.
6.2. Orders can be placed by adding products to the cart and completing the order form.
6.3. Before placing an order, the user is obliged to read the product description and its price.
6.4. Placing an order is equivalent to accepting these terms and conditions and the sales conditions.
6.5. After placing an order, the user receives an order confirmation to the provided email address.

7. Payments
7.1. Payments for ordered products can be made through the payment methods available on the portal.
7.2. The user is obliged to make the payment within the period indicated in the order confirmation.
7.3. In case of non-payment within the period, the administrator reserves the right to cancel the order.
7.4. All prices listed on the portal are gross prices, including VAT.
7.5. The administrator reserves the right to change product prices without prior notice to users.

8. Order Fulfillment and Delivery
8.1. Order fulfillment begins after the seller receives payment for the ordered products.
8.2. The ordered products are delivered directly by the sellers to the address provided by the user in the order form.
8.3. Delivery time depends on product availability and the chosen delivery method, ranging from 2-5 days.
8.4. Sellers make every effort to ensure deliveries are made as quickly as possible.
8.5. In case of a delay in order fulfillment, the seller informs the user of the estimated delivery date.

9. Complaints and Returns
9.1. The user has the right to file a complaint in case of a defective or non-compliant product.

9.3. The complaint should include the user’s details, a description of the product defect, and the order number.
9.4. The administrator forwards the complaint to the appropriate seller, who reviews it within 14 days of receipt.
9.5. If the complaint is upheld, the user may request repair, replacement of the product, a price reduction, or withdrawal from the contract.
9.6. The user has the right to return purchased products within 14 days of receiving them without giving any reason.
9.7. Product returns are at the user’s expense, unless otherwise agreed by the parties.
9.8. Returned products must be complete, in the original packaging, and must not show signs of use.
9.9. Refunds for returned products are made within 14 days of the seller receiving the returned products.

10. Personal Data Protection
10.1. The administrator processes users' personal data in accordance with applicable laws and the privacy policy.
10.2. Users' personal data is processed to fulfill sales contracts, handle complaints and returns, and for marketing purposes.
10.3. The user has the right to access their personal data, rectify it, delete it, limit its processing, and transfer data.
10.4. The user may withdraw consent to the processing of personal data at any time, without affecting the legality of processing based on consent before its withdrawal.
10.5. The administrator applies appropriate technical and organizational measures to protect personal data from unauthorized access, loss, destruction, or alteration.

11. Liability
11.1. The administrator is not responsible for interruptions in the portal's operation due to reasons beyond their control, such as technical failures, internet service disruptions, or other random events.
11.2. The administrator is not responsible for damages resulting from improper use of the portal by the user.
11.3. The user is responsible for all actions taken through their account on the portal, including the consequences of disclosing login details to third parties.
11.4. The administrator reserves the right to temporarily suspend the portal’s operation for maintenance or system updates.
11.5. The administrator is not responsible for content posted on the portal by users, including its truthfulness, completeness, and compliance with the law.

12. Changes to the Terms and Conditions
12.1. The administrator reserves the right to make changes to the terms and conditions at any time.
12.2. Changes to the terms and conditions come into effect upon their publication on the portal.

13.3. In case of withdrawal from the contract, the user is obliged to return the products to the seller’s address within 14 days of the withdrawal statement.
13.4. The seller refunds the user all received payments, including delivery costs (except for additional costs resulting from the chosen delivery method other than the cheapest standard delivery method offered by the seller), no later than 14 days from receiving the returned products.
13.5. Refunds are made using the same payment methods used by the user in the original transaction unless the user expressly agrees otherwise; in any case, the user does not incur any fees related to the refund.

14. Loyalty Programs
14.1. The administrator may organize loyalty programs for portal users, which will be governed by separate regulations.
14.2. Participation in loyalty programs is voluntary and available to registered portal users.
14.3. Detailed rules and conditions for participation in loyalty programs will be published on the portal and sent to participants electronically.

15. Newsletter
15.1. Users can subscribe to the newsletter to receive regular information about news, promotions, and events related to the portal's offer.
